In 1896, James and his sister Susan Green applied for membership in the Cherokee Nation. They were among the many rejected. Here is the transcription of the handwritten cover of their application document. Their mother, said to be at lest half Cherokee, but full-blood according to some family sources, had been rejected also. Minerva Owens Barnett finally issued an affidavit giving up her attempt, after long and expensive attempts to get a positive hearing, when her primary witness died with her case unresolved.

James and Susan made their application at Fort Gibson, and in 1900 Susan and her husband Jacob Green were enumerated in Cherokee for the 1900 census. James and his family, however, were way south near the Texas border, enumerated at Marietta in Chickasaw Nation.
This is the area that became Love County, Oklahoma. He and Christina have had only the one child Christopher. James' mother Minerva is living with them, after her husband John passed away in 1897.

There are 3 boarders in the household, all working as Farm Laborers. It is not clear if they are working for James or elsewhere. James' birth year as 1956 does not match ages in previous censuses, which generally place his birth in about 1854. 1880, however, makes his birth year about 1858, so there is a wide variation. It appears the next door neighbor is Christina's brother. The head of the household is John Maines.
